The NeuroFlow app stores and processes personal data that you have provided to us in order to provide and improve our services.

You understand that by using the services you agree to the collection and use as set out in the Privacy Policy, including the transfer of this information to other countries for storage, processing and use by NeuroFlow.

Passwords

You are responsible for safeguarding the password you use to access the Services and any activities or actions under your password. We encourage you to use strong passwords, which use a combination of upper and lower case letters, numbers, and symbols, for your account. NeuroFlow cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

Content in the services

All Content is the sole responsibility of the person from whom such Content originated. Any use of or reliance on any Content or materials posted through the Services or obtained by you through the Services is at your own risk.

The app does not support, represent, endorse, or guarantee the integrity, truthfulness, accuracy, or reliability of any Content, communication, or opinions submitted through the services. You understand that by using the services, you may be exposed to Content that may be offensive, harmful, inaccurate, or otherwise inappropriate. Under no circumstances will NeuroFlow be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, uploaded, transmitted, or otherwise made available through the services or broadcast elsewhere.

Your rights

You retain your rights to any Content you submit, post, or display on or through the Services. By submitting, posting, or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods (now known or later developed).

You agree that this license includes the right for NeuroFlow to provide, promote, and improve the Services and to make content submitted to or through the Services available to other companies, organizations, or individuals who have a partnership with the app for the distribution, transmission, syndication, or publication of such content in other media and services, subject to our terms and conditions for such use of content.

We may modify or adapt your Content in order to transmit, display or distribute it over information networks and in various media and/or make changes to your Content that are necessary to adjust and adapt such Content to any requirements or limitations of any network, device, service or media.

You are responsible for your use of the Services, for any Content you provide, and for all consequences thereof, including the use of your Content by other users and our third-party partners. NeuroFlow will not be liable for any use of your Content in accordance with these Terms. You represent and warrant that you have all rights, power, and authority necessary to grant the rights granted herein for any Content you submit.

NeuroFlow app rights

All rights, title, and interest in and to the Services (excluding content provided by users) are and will remain the exclusive property of NeuroFlow and its licensors. Nothing in these Terms gives you the right to use the NeuroFlow name or any of its trademarks, logos, domain names, or any other distinctive features. Any feedback, comments, or suggestions you provide to us or the Services are entirely voluntary, and we will be free to use such comments or suggestions as we see fit and without any obligation to you.

All rights, titles and interests in and to the NeuroFlow app technology providers are and will remain the exclusive property of their legal owners.

Good practices and rules for using services

Be polite. Everyone should feel comfortable reading the Content and participating in the Service.

Do not create or respond to Content about any type of criminal activity.

NeuroFlow reserves the right to remove Content and ban the user who created it in cases of insults, inappropriate, indecent, defamatory, aggressive, intimidating, threatening material, hate speech, discriminatory, abusive, vulgar, obscene, pornographic, sexually explicit, offensive to race, culture or ethnicity.

Stay within the law

Do not create Content with the intent to promote or commit illegal acts.

Do not create Content containing defamatory material.

Content must be yours or something to which you have legal right. You warrant and represent that you own or otherwise control all rights to the information contained in your Content.

Termination of these terms

The Terms will continue to apply until terminated by either you or NeuroFlow as follows.

You may terminate your contract with NeuroFlow at any time for any or no reason by deactivating your accounts and stopping your use of the services by deleting your profile created in the app.

We may suspend or terminate your accounts or cease providing you with all or part of the Services, at any time, for any reason or no reason, including, but not limited to, if we believe: (i) you have violated these Terms, (ii) you create risk or possible legal exposure for us; or (iii) providing Services to you is not commercially viable. We will use reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account.

Disclaimers and Limitations of Liability

Please read this section carefully as it limits the liability of NeuroFlow and its owners, subsidiaries, affiliates, related companies, officers, directors, employees, agents, representatives, partners, suppliers, and licensors (collectively, the “NeuroFlow App Entities”).

A. Services are available “AS IS”

Your access to and use of the Services or any Content is at your own risk. You understand and agree that the Services are provided on an “AS IS” and “AS AVAILABLE” basis.

The NeuroFlow app Entities make no warranty or representation and assume no responsibility for: (i) the completeness, accuracy, availability, timeliness, security, or reliability of the services or any Content; (ii) any damage to your device or system, loss of data, or other harm resulting from your access to or use of the services or any Content; (iii) the deletion of, or failure to store or transmit, any Content or other communications maintained by the services; and (iv) whether the services will meet your needs or will be available on an uninterrupted, secure, or error-free basis. No information, whether oral or written, obtained from the NeuroFlow Entities or through the services will create any warranty or representation not expressly made herein.

The Services may contain links to third-party websites or resources. You acknowledge and agree that the NeuroFlow Entities are not responsible for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any responsibility for the NeuroFlow Entities for such websites or resources, or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risks arising from your use of any such websites or resources.

C. Limitation of Liability

THE NeuroFlow ENTITIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL MATERIAL OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR SERVICE OR CONTENT.
